General

This privacy policy is created for the Eat Halfway mobile application (hereinafter "the Application" and the “Data Controller”).

Terms not defined in this privacy policy or in the General Terms and Conditions of Use of the Application will have the meaning given in the EU General Data Protection Regulation and in French data protection legislation.

The purpose of this privacy policy is to inform you, as a User of the Application, of the details of how the Data Controller processes your personal data collected through their Application.

The personal data collected on the Application is in agreement with the User and is intended to improve his experience on the Application or via the Services.

What data? When?

The Data Controller collects the following data:

  • User identification data (such as last name, first name, identity photograph, username, password, electronic contact details) excluding sensitive or dangerous data;
  • User connection data (such as IP address, connection city, access provider).

This data is collected while the User:

  • Accesses the Application,
  • Creates or modifies their account on the Application,
  • Provides information on their position or that of other participants,
  • Modifies filters,
  • Puts a restaurant in your Wish List,
  • Shares their choice with their friend(s)

The requirement to provide mandatory data is of a regulatory or contractual nature or it conditions access to the services of the Data Controller.

Access to the services of the Data Controller on the Application cannot be granted if this information is not provided.

By voluntarily providing optional data, the User expressly accepts that they will be processed under the conditions and for all of the purposes below.

Cookies and social media

Operational navigation on the Application makes it necessary to use cookies, which are mini-software “trackers” installed on the User's terminal, and which give the Data Controller access to standard connection information.

Audience Measurement

In order to improve the Application and its services, User browsing data is collected in order to measure usage and the number of pages viewed. Google Analytics, the tool used to collect its data uses cookies, as described on the official website of Google.

Social media

The Data Controller is present on various social networks, in particular Instagram. As such, the Data Controller is likely to process the public data of the profiles of social network users who share, subscribe, follow or come into contact with the Data Controller on these platforms.

The Data Controller cannot be responsible for the User's public data, accessible on these networks and platforms. The User is therefore advised to read the privacy policies applicable on each of these platforms in order to configure their privacy settings.

Purpose of processing personal data

The Data Controller processes the User's personal data to provide him with the services offered via the Eat Halfway application and to communicate with him.

More specifically, the purpose of the Eat Halfway Application is to make it easier for its users to socialize by offering restaurant or bar suggestions halfway between users according to the addresses provided, the modes of transport provided, and the filters chosen.

The Data Controller processes the User's personal data to provide him with the services offered via the Eat Halfway application and to communicate with him.

The purpose of the processing of the User's personal data by the Data Controller is:

  • The operation of the application which makes it possible to provide restaurant and bar recommendations;
  • The performance of audience measurement, in particular the number of Users of the Application, the activity of Users of the Application, their frequency of use and other statistical purposes;
  • The improvement of its products and services by inviting participants to participate in surveys, studies, satisfaction surveys and product tests;
  • The provision of personalized content (“Wish List”);
  • The personalization of the products and services it offers;
  • Sending information to the User’s customer account;
  • Sending newsletters by electronic communication to the User;
  • The management of requests for the right of access, rectification and opposition;

If the User's personal data were to be processed for different purposes, the Data Controller undertakes to inform them and, when required by law, to obtain their prior consent.

Legal basis – About applicable law

The processing and protection of personal data of the Application are governed by the terms hereof and by the provisions of French, European and international law on the protection of individuals with regard to the processing of personal data.

The personal data of Users are processed by the Data Controller in accordance with the regulations in force, and in particular under the following conditions:

  • when the User has given free, specific, informed and unambiguous consent to the processing of their data;
  • when the legitimate interests of the Data Controller justify it (eg: security measures, operation of the Application, etc.);
  • when this is necessary for the exercise or defense of a legal right of the Data Controller

Recipients of personal data

The Data Controller communicates the data collected to the technical service providers responsible for the maintenance and hosting of his/her computer system and that of the Application.

These recipients may need to contact the User directly using the contact details provided.

The Data Controller requires these recipients to use the User's personal data only to manage the services for which they are responsible and in accordance with the applicable laws and regulations on the protection of personal data.

Where applicable, the User's personal data may be communicated to third parties authorized by law (in particular as part of an express and reasoned request from the judicial authorities).

Likewise, if the Data Controller is involved in a merger, acquisition, transfer of assets or bankruptcy proceedings, he may be required to sell or share all or part of his assets, including personal data. of the User. In this case, the User will be informed, before any transfer of his personal data to a third party.

Finally, the Data Controller reserves the right, after the express authorization of the User, to use directly or indirectly (by transmitting them for example to his partners) the personal data of the Users for commercial prospecting purposes.

Storage of personal data

Eat Halfway stores your data on servers located in the United States and managed by Google Cloud Platform, which adequately respects personal data. You can consult the current decisions of the European Commission on adequacy. To transfer data from the EEA to other countries, such as the United States, Google Cloud Platforms follows legal frameworks that establish a level of protection equivalent to that of the EU.

Security measures and access control

Appropriate and detailed security policies, rules and technical measures are implemented to protect your personal data processed through the Application against inappropriate or unauthorized access, against alteration and destruction of data. Requests that do not present the security identity of the sending entity are rejected.

All employees and subcontractors, who have access to and are associated with the processing of personal data, are required to respect the confidentiality of your personal data.

Retention period of personal data

The data is kept in accordance with the law for a period justified by the purpose of the processing and, in any case, for the periods of legal storage.

User rights

In accordance with the provisions of Regulation No. 2016/679 of April 27, 2016 and of Law No. 78-17 of January 6, 1978 as amended, the Data Controller clearly and fully informs the User of the rights available to him.

The user has the right to access, rectify and delete his personal information and may object to its processing and commercial exploitation.

The User must specify in his request his surname, first name, e-mail address or postal address to which he wishes the response from the Data Controller to reach him.

For security reasons and to avoid any fraudulent request, this request must be accompanied by proof of identity. After processing the request, this document will be destroyed.

In accordance with the law, this request will be answered within one month of its reception by the Data Controller.

Changes to this privacy policy

We may update our privacy policy from time to time. Thus, it is advisable to consult this page periodically for any changes. We will notify you of any changes by posting the new privacy policy on this page. These changes are effective immediately upon posting on this page.
